REGULAR CITY COUNCIL MEETING
MINUTES
December 16, 2009
Council meeting called to order at 7:00 P.M. by Mayor Gene Becker
Roll Call: C. Loots, C. Meyer, S Juilfs, R Bachman and D DeVore.
MAYOR AND COUNCIL COMMENTS: R Bachman informed the Council of a complaint he received about the snow removal by the City Employees. The Council asked if the sidewalks in front of the Mall could be cleaned off.
APPROVAL OF AGENDA: C Meyer made a motion, seconded by C Loots, to approve the agenda. Roll call: Ayes R. Bachman, C. Meyer, C. Loots, D DeVore and S Juilfs. Motion carried. Corrections to the November 10th minutes, D DeVore asked if anyone knew why the Fire Dept. had the trucks out on Saturday night Nov. 7th; a motion was made by C Meyer, seconded by R Bachman to approve the Tobacco Permit at the Pomeroy Area Market. Roll call: Ayes R. Bachman, D DeVore, C. Meyer, C. Loots, S Juilfs. Motion carried.

CONSENT AGENDA: R Bachman made a motion, seconded by S Juilfs, to approve the consent agenda: Financials, Minutes, Requests, Reports, and Bill List. Roll call: Ayes R. Bachman, D DeVore, C. Meyer, C. Loots, S Juilfs, Motion carried.

COMMITTEE REPORTS: 
Library: C Meyer made a motion, seconded by C Loots, to approve Sharon DeVore as a new Library Board member. Roll call: Ayes R. Bachman, D DeVore, C. Meyer, C. Loots, S Juilfs. Motion carried.
Nuisance Abatement Hearing: Mayor Becker and Council Member DeVore will be meeting with Steve Johnson next week due to Mr. Johnson being unable to attend the Council meeting.
Water/Sewer/Streets: John Devitt was on hand to discuss the Sewer Lagoon project. He informed the Council of a mistake he made on last month’s final pay request so the Council will have to reapprove the final pay request and void the previous months. Motion was made by C Meyer, seconded by R Bachman to correct the motion made last month for the payment to R & R Excavating for $76,319.13 to $55,555.93, and approve payables for Kuehl and Payer for $671.20 and Midas for $1,025.00. Roll call: Ayes R. Bachman, D DeVore, C. Meyer, C. Loots, S Juilfs, Motion carried. Mayor Becker, R Bachman and D DeVore are to meet at the maintenance shed Wednesday Dec. 23 to plan where to place the electricity in the building so the City can ask for bids for the project. The Council asked that the street project be placed on next month’s agenda so that City Hall may contact possible engineers. The City Clerk asked what steps should be taken to shut off a delinquent customer who’s shut off is located underneath their driveway. The Council agreed that the City should first contact the customer informing them that if bill is not paid for the City will rip up the drive way at the owner’s expense.
Fire Dept: Acting Chief Rosa announced the results of their election of officers from the Nov 16th Fire Dept. meeting. C Meyer made a motion seconded by C Loots to approve officers Chief Dan Rosa, Asst. Chief Bruce Ewing, Captain Jeremy Norris, Lieutenant Doug Hepperle and Sec/Tres Merissa Ewing. Roll Call. Ayes: C Loots and C Meyer. Nays: S Juilfs, D DeVore and R Bachman. Motion denied. The Council asked Chief Rosa if the majority of the members where present for the vote. Chief Rosa said the secretary would have the names of the members present and the Council asked if they would be able to have more members at the December meeting to take another vote and report back to the Council at the January meeting.
Police: Tony Hinners was present to address the shooting of his dog within City limits. Police Chief Gerdes investigate the incident and spoke with the County Attorney; it was determined to be a civil matter. A resident complained about a loose dog and chickens at 703 S Ontario St. The Council asked that “No Parking Farm to Market” signs be placed on Harrison Street. The City Clerk asked if the Slow Children Playing sign at 304 S. Seneca St. could be removed because it is in the way of snow removal and no children live on that block. Council asked that Kenny Rhea pull the sign out.
Cemetery: C Loots asked the Council to look into the Iowa Code regarding how Perpetual Cemetery Funds may be spent and consider fixing old or broken stones next summer. City Hall is to look into the statute of limitations on selling a cemetery plot that’s hasn’t been used since 1941. C Loots asked if the volunteer group could renovate the gazebo park, south of the Historical Society, by applying for a Calhoun County Community Grant and money from the can redemption. C Loots will be back in the summer with more definitive plans for the park.
City Hall: A motion was made by C Meyer, seconded by D DeVore, to approve Byron’s liquor license. Roll call: Ayes R. Bachman, D DeVore, C. Meyer, C. Loots, S Juilfs, Motion carried. The City Clerk informed the Council that the deadline to the Energy Efficiency & Conservation Block Grant program was December 14th. C Loots asked the Council to be thinking of ideas for the Calhoun Co. Community Foundation matching grant program for January’s meeting.
Ordinance: #207 Amending Chapter 3 Utilities – Refuse Collection D DeVore made a motion seconded by C Loots to have the first reading of Ordinance #207. Roll call: Ayes R. Bachman, D DeVore, C. Meyer, C. Loots, S Juilfs, Motion carried. C Meyer read Ordinance #207. A motion was made by C Loots, seconded by D DeVore, to approve the first reading of Ordinance #207. Roll call: Ayes: D DeVore, C. Loots and S Juilfs. Nays: C. Meyer and R. Bachman. First reading of Ordinance #207 passed on December 16th, 2009.
