Public Hearing: called to order at 7:00 P.M. by Mayor Gene Becker
Roll Call: D. Devore, C Loots, C. Meyer, S Juilfs, and R Bachman. Absent: None
Brad Cutler from MIDAS Council of Governments updated the Council on the status of the Sewer lagoon project. The lift station and lagoon have been completed and are in operation. The remaining work that needs to be completed is to finish grading, seeding and fencing. Summary of expenditures to date: $231,411 has been expended in CDBG funds to date and $876,081.68 has been expended in local funds to date. Total expended to date $1,107,492.68.

Council meeting called to order at 7:04 P.M. by Mayor Gene Becker
Roll Call: D. DeVore, C. Loots, C. Meyer, S Juilfs, and R Bachman. Absent: None
MAYOR AND COUNCIL COMMENTS: Correction to July 16th minutes: C. Meyer made a motion, second by Bachman to approve the Consent Agenda: Financials, Minutes, Requests, Reports, and Bill List. Roll Call. Ayes: Bachman, Meyer, DeVore and Loots. Nays: None. Motion Carried. Meyer made a motion seconded by Loots to reimburse Robert Schossow/Historical Society $150 for the purchase of a small freezer for the Community Building. Roll Call. Ayes: Bachman, Meyer, DeVore and Loots. Nays: None. Motion Carried. Correction to the July 23rd minutes Loots abstained from the vote due to a possible conflict of interest in family ties with one of the applicants.
APPROVAL OF AGENDA: Meyer made a motion, second by DeVore to approve the Agenda. Roll call. Ayes: Bachman, Meyer,
DeVore, Juilfs and Loots. Nays: None. Motion Carried.

and Bill List. Roll call. Ayes: Bachman, Meyer, DeVore, Juilfs and Loots. Nays: None. Motion Carried.
COMMITTEE REPORTS  
Water/Sewer/Streets: Teri Sorenson asked the Council to have her sewer charges refunded to her due to the recent finding that
the property is not hooked into the City Sewer System. Meyer made a motion, seconded by Loots to reimburse Teri Sorenson for sewer fees and charges incurred between December 2007 to July 2009. Roll call. Ayes: Bachman, Meyer, DeVore, Juilfs and Loots. Nays: None. Motion Carried. The Council discussed the progress with the new maintenance shed and also tabled the discussion of the water, sewer and electric hook ups till the September 8th regular City Council meeting.
Grocery Store: Nick Graham was present to talk to the Council about bringing a grocery store to town;
he is also the owner of the Rolfe grocery store. He hopes to open a store in town by mid-September to mid-October. He also mentioned that the store in Rolfe makes deliveries and would like to provide that service in Pomeroy. The Council asked him to attend a Town Meeting on Aug. 24th to answer questions from the public and to see what interest the community has in the grocery store. City Hall is to place an ad in the paper and posters around town to inform the public of the town meeting.
Park: A volunteer group will be placing the 3rd swinging bench at the park right south of the Historical Society Building.
Getting bids for grinding out stumps was tabled to the next meeting.
Community Building: Don Langenwalter will be updating the bathrooms in the community building following the Amvets celebrations.
Council member Loots said she will also ask for a bid to replace the two front windows that Herald Larson had said need replacing due to rotting frame work.
Fire Department:The Council told the Dept that they could repair the red truck using their city budget money. The Fire Chief also
discussed the USDA Grant that they were awarded for $11,000 has to be spent on “American made” air packs. The Fire Chief was going to make sure the sales representative understands that.
Ambulance:The Council reviewed an updated given by Kerrie Hull. There were 92 calls last year in the Pomeroy area,
42 of those times someone from the Pomeroy Ambulance was able to assist or transport by themselves. The Pomeroy Dept is able to have a full crew on call Monday-Thursday for the night time coverage, daytime and weekends do not have anybody available. Kim Gutz gave a list of the current members there are 6 drivers and 5 EMTS with one also being a RN.
Garbage:The Council changed the pickup times from 2 to 3 times a month for Gray Sanitation to come pick up the recycling
bin for a few months to see if it works better. Duane Shuttller gave the Council a contract for garbage pickup in the City of Pomeroy. The Council discussed that they would have to update the City ordinances pertaining to refuse collection so that it didn’t conflict with the contract, amending the ordinance was tabled to the next regular meeting on Sept 8th.
Police Department: Chief Gerdes was asked to get quotes for a new computer for the dept. She also informed the Council that the Police
has a new email address pomeroy.police@yahoo.com. Amending the Truck route “Farm to Market” ordinance was tabled to the next meeting. Council member DeVore and Chief Gerdes are going to work together to get letters out to nuisance properties. The Council discussed a complaint made about having roosters in town. The Council discussed the use of ATV’s and golf carts in town and left it to Chief Gerdes’ discretion as to whether they be allowed or not, she stated that she has no problem with them as long as they obey traffic laws.
Nuisance abatement:Charles Haack complained to the Council about nuisance properties in his neighborhood.
The Council turned the properties over to Council member DeVore and Chief Gerdes.
City Hall The Council tabled the discussion on vacating an alley till the next meeting to do some research on the process of vacating an
alley. A motion was made by Meyer, seconded by Bachman to approve the September 5th street dance at Byron’s as long as Byron talks with Chief Gerdes about enclosures and she approves it. Roll call. Ayes: Bachman, Meyer, DeVore, Juilfs and Loots. Nays: None. Motion Carried. The City Clerk will contact Byron to inform him. Council member Loots commented that the Council should watch the Zoning Administrator to make sure all are treated fair. The Council reviewed the 2007 and 2008 audit and asked to put a return check fee and reimbursement on travel expenses ordinance on next month’s agenda and also that there be a written policy on passwords in City Hall.
Ordinance #206: Salaries of Municipal Officers: Motion by Meyer, seconded by DeVore to approve ordinance #206 amending the pay per
meeting of the City Clerk. The City Clerk shall receive an hourly wage for the meeting or $50.00 per meeting, whichever is higher be it effective upon publication. Roll call. Ayes: Bachman, Meyer, DeVore, Juilfs and Loots. Nays: None. Motion Carried. Motion was made by Meyer, seconded by Loots to waive the 2nd and 3rd reading. Roll call. Ayes: Bachman, Meyer, DeVore, Juilfs and Loots. Nays: None. Motion Carried.
Public Comments: Sherry Ricky asked to be on next month’s agenda to get approval from the Council to have a rooster in town.
Koda Snyder complained to the Council about Chief Gerdes not being certified in Iowa, the Council stated that she has one year to complete her certification.
